Notice on the Right to Object under Art. 21 GDPR

You have the right to object at any time, for reasons arising from your particular situation, to the processing of your personal data based on Art. 6 (1) (e) or (f) GDPR (Art. 21 (1) GDPR). If your personal data is processed for direct marketing purposes based on Art. 6 (1) (f) GDPR, you have the right to object at any time without providing reasons (Art. 21 (2) GDPR). In such cases, we will no longer process your data unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims. § 3 Collection, Processing, and Use of Personal Data during Informational Use

(1) If you visit our website without providing any personal information, we do not know who you are. In this case, we receive only communication data from your browser without any direct reference to your identity. In this context, we collect the following data: your IP address, the date and time of the request, the access status or HTTP status code, the amount of data transferred, the browser used, the operating system and its interface, the language and version of the browser software, the website from which the request originates, the content of the request, and the time zone difference to GMT. § 4 Collection of Personal Data for Personalized Use; in Particular Contact Forms and Applications

(1) In addition to the purely informational use of our website, we offer various services that you can use if interested. To do so, you will generally need to provide additional personal data, which we use to provide the respective service. If additional voluntary information is possible, this will be indicated accordingly. The data processing is carried out in accordance with Section 26 (1) sentence 1 of the German Federal Data Protection Act (BDSG) for the purpose of conducting the application process ("decision on the establishment of an employment relationship"). Unless you have given explicit consent for your data to be stored beyond the specific application process, we will delete your data six months after the conclusion of the recruitment process. The application process is considered concluded when the period in which legal action could still be taken due to a violation of the General Equal Treatment Act (AGG) has expired, which is typically five months after the rejection has been sent, provided that no legal action or claim has been filed under Section 15 (4) AGG within that period.

§ 5 Transfer of Personal Data to Third Parties

(1) We use external service providers and other services in certain cases, including hosting providers, statistical and analytics services, as well as IT maintenance and development service providers.

(2) In doing so, we fully comply with all applicable data protection regulations and, where necessary, contractually require our service providers to do the same.

(3) Beyond this, we do not share your personal data unless an authority is exceptionally entitled to request it, for example, for law enforcement or threat prevention purposes.

(4) The aforementioned processing activities may also result in the transfer of data to recipients outside the European Union (see Google Analytics below). § 6 Use of Google Analytics

(1) This website uses Google Analytics, provided that its use has been enabled in the website's privacy settings (under the "Analytics Cookies" section). Google Analytics is a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies," which are text files stored on your computer that enable an analysis of your website usage. The information generated by the cookie regarding your use of this website is generally transmitted to and stored on a Google server in the United States. § 7 Use of Google AdSense

Google Tag Manager is a tool that enables us to integrate tracking or analytics tools and other technologies on our website. The Google Tag Manager itself does not create user profiles, store cookies, or perform independent analyses. It is solely used for managing and deploying the tools integrated through it. However, Google Tag Manager does collect your IP address, which may be transmitted to Google's parent company in the United States.

(2) The use of Google Tag Manager is based on Art. 6 (1) lit. f GDPR, as the website operator has a legitimate interest in the quick and easy integration and management of various tools on the website. (1) Our company operates an online presence on LinkedIn. The provider is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland.

This is a subsidiary of LinkedIn Corporation, 1000 W. Maude Avenue, Sunnyvale, CA 94085, USA.

(2) If the use of LinkedIn has been activated in the website’s privacy settings (under "Analytics Cookies"), it is possible that user data will be processed outside the European Union, particularly in the United States. This may make later access to user data more difficult. We do not have access to this data, as it is exclusively managed by LinkedIn.

§ 10 Newsletter

(1) By subscribing to our newsletter, you agree to receive newsletters and notifications from us. These may include updates on the latest developments in the E-Learning industry, as well as information about FKC and the promotion of our own products and services.

(2) Subscription to our newsletter follows the double opt-in process. After signing up, you will receive an email at the address you provided, requesting confirmation of your subscription. Your subscription must be confirmed within 24 hours; otherwise, your information will be blocked, and after one week, it will be automatically deleted.

(3) To subscribe to the newsletter, only your email address is required. Providing additional data is voluntary and is used solely for personalized communication. Once you confirm your subscription, your email address will be stored for the purpose of delivering the newsletter. Additionally, your IP address and the timestamps of your registration and confirmation will be recorded to verify your subscription and prevent potential misuse of your personal data. The legal basis for this processing is Art. 6 (1) sentence 1 lit. a GDPR.

(4) You may revoke your consent at any time. You can unsubscribe from the newsletter via the unsubscribe link provided in each newsletter email or directly on our website under Newsletter Unsubscription.

§ 11 Embedding of YouTube Videos

(1) We have embedded YouTube videos on our website. These videos are stored on http://www.youtube.com and can be played directly from our website. All embedded videos use "enhanced privacy mode", which means that no data about you as a user is transmitted to YouTube unless you actively play the videos. Data is only transmitted once you start playing a video, as described in paragraph 2 below. We have no control over this data transmission.

(2) When you visit a subpage of our website that contains a YouTube video, YouTube receives information about this visit. Additionally, data mentioned in § 3 of this privacy policy is transmitted. This occurs regardless of whether you have a YouTube account or are logged in to YouTube. If you are logged in to a Google account, your data is directly associated with your profile. To avoid this association, you should log out of your Google account before playing a video. YouTube stores collected data as user profiles and uses them for purposes such as advertising, market research, and personalized website design. This analysis is conducted even for users who are not logged in. Other social network users may also be informed about your activity on our website. You can object to the creation of such user profiles directly with the respective social media provider.

(3) The legal basis for the use of YouTube is Art. 6 (1) lit. f GDPR, as embedding YouTube videos serves the legitimate interests of the website operator. These interests include the provision of customized advertising and informational content through YouTube videos, as well as informing other social network users about activities on our website.

§ 12 Protection of Personal Data

We implement technical and organizational measures in accordance with the requirements of Article 32 GDPR to protect the personal data of users. All employees who are involved in the processing of personal data are bound by data confidentiality. Personal data transmitted to our website is encrypted using HTTPS to ensure secure transmission.

§ 13 Legal Basis

In accordance with Article 13 GDPR, we inform you about the legal basis for our data processing activities:

If we obtain consent from the data subject for the processing of personal data, Article 6 (1) lit. a GDPR serves as the legal basis.
If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, Article 6 (1) lit. b GDPR serves as the legal basis. This also applies to processing operations required to take steps prior to entering into a contract.
